BuyDude is a digital marketplace (“Application”) that enables registered suppliers (“Suppliers”) to offer their products for sale to registered users of the Application (“Resellers”). The Application and the website at buydude.in (“Website”) (collectively referred to as the “Platform”) are managed by STEEL MERCH COMMERCE CHAIN INDIA PVT LTD (“the Company”), which includes its directors, full-time employees, subsidiaries, and affiliates. The Company’s role is confined to managing the Application, conducting marketing activities, collecting payments, managing orders, handling inquiries, and providing other ancillary services to facilitate transactions between Suppliers and Resellers. The Application is designed for use as a standalone mobile application and is not available for access via a browser environment.

By engaging with the Platform, whether as a Supplier or a Reseller, users agree to adhere to the terms and conditions set forth by the Company, ensuring a smooth and efficient operation of the marketplace. The Company is dedicated to providing a secure and effective environment for users to conduct their transactions, with the ultimate goal of fostering successful business relationships within the BuyDude community..

These Terms, along with the Privacy Policy available at  buydude.in, constitute a legally binding agreement (“Agreement”) between the User and the Company, taking effect from the date the User downloads the Application or uses the Website and/or from the date they are updated.

Users can review the most current version of the Terms and Policies at any time on this page. The Company reserves the right to update, change, or replace any part of these Terms by posting updates or changes to the Application. It is the Users’ responsibility to check this page periodically for changes. Continued use of or access to the Application following the posting of any changes constitutes acceptance of those changes. As long as Users comply with these Terms, the Company grants them a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform and services.

User Eligibility: Users represent and warrant they have the right to access or use the Platform. Individuals who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872, including minors, un-discharged insolvents, etc., are not eligible to use the Platform.

The Platform is accessible to individuals and business entities, including sole proprietorship firms, companies, and partnerships, capable of forming legally binding contracts under the Indian Contract Act, 1872. Only individuals who are eighteen (18) years of age or older may use the Application and avail Services. The Company reserves the right to terminate a User’s account and/or deny access to the Platform if it is discovered that the User does not meet these conditions.

Account Registration, Suspension, and Termination: The Company requires Users to register on the Application to access and view its contents. During the registration process, Users agree to provide accurate, current, and complete information and to update such information to maintain its accuracy.

Users are required to enter a valid phone number while registering on the Platform. By registering, Users consent to be contacted by the Company via phone calls, SMS notifications, or instant messages for verifications and updates on subscriptions/services/promotions. Users may opt out of subscription/service/promotional updates.

Upon registration, Users may undergo a verification process. Users are responsible for maintaining the confidentiality of their account information and are fully responsible for all activities that occur under their account. They must immediately notify the Company of any unauthorized use of their account or other breaches of security.

The Company reserves the right to suspend or terminate a User’s account, block any due amounts, and/or deny access to the Application if:

• Information provided during the registration process or thereafter is found to be inaccurate, not current, or incomplete; and/or
• The User engages in fraudulent activities or actions detrimental to the Company’s interests or is found non-compliant with the Terms, Policies, and/or Privacy Policy.

Amendment to the Terms: The Company reserves the right to modify these Terms and/or the Agreement from time to time, and such amended provisions shall be effective immediately upon being posted on the Platform. Users who do not agree with the revised provisions must cease using the Platform immediately. Continued use of the Platform will be deemed as acceptance of the amended provisions.

Orders and Financial Terms: The Application enables Users to place orders for products sold by various Suppliers, with the Company facilitating the placement of orders subject to these terms. The Company does not own, sell, or control the Suppliers or the products offered. All commercial/contractual terms, including but not limited to pricing, shipping costs, and payment methods, are agreed upon between the Suppliers and Users directly.

Accuracy, Completeness, and Timeliness of Information: The Company is not responsible for any inaccuracy, incompleteness, or outdated information provided on the Application. The material on the Application is provided for general information only and should not be the sole basis for making decisions without consulting more accurate, complete, or timely sources of information.

Disclaimers of Warranty and Limitation of Liability: The Company provides the Application on an “as is” and “as available” basis, without warranties of any kind. The Company is not liable for any direct, indirect, incidental, punitive, special, or consequential damages arising from the use of the Application.

Indemnification: Users agree to indemnify, defend, and hold harmless the Company from any claims, damages, expenses, and liabilities arising from their use of the Platform or their breach of these Terms.

Governing Law and Dispute Resolution: These Terms are governed by the laws of India. Any disputes arising under or in connection with this Application shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

Notices: All notices to the Company must be in writing and sent to Unit 430, F-Wing, Solaris-1 Complex, Sakhi Vihar Road, Andheri (E), Mumbai-400072. Notices to Users will be deemed effective if delivered personally, sent by courier, certified mail, facsimile, email, or posted on the Platform.

Miscellaneous: These Terms include provisions regarding user responsibilities, privacy policy, intellectual property rights, and other aspects of Platform use. Users are encouraged to review these Terms carefully and contact the Company with any questions or concerns.
